Waiver and Release of Liability

In consideration of my participation in events, meetings, conferences, and activities organized or sponsored by Phi Sigma Sigma, Inc., its subsidiaries and/or subordinate units (collectively “Phi Sigma Sigma”), I voluntarily agree to the following:

1. Acknowledgment of Risk
   I acknowledge and understand that Phi Sigma Sigma’s insurance policy does not provide coverage for members who drive personal or other vehicles to and from Phi Sigma Sigma events, meetings, conferences, or activities. I understand that I am solely responsible for my own transportation to and from such events, and that any travel I undertake in connection with Phi Sigma Sigma activities is at my own risk.
   
   I further acknowledge that driving a motor vehicle involves inherent risks, including but not limited to traffic accidents, bodily injury, property damage, and death. I understand that these risks exist regardless of the care and precautions taken by Phi Sigma Sigma or me.
2. Assumption of Risk
   I voluntarily assume all risks associated with my transportation to and from Phi Sigma Sigma events, meetings, conferences, or activities, including but not limited to risks arising from vehicle operation, road conditions, weather, the conduct of other drivers, vehicle mechanical failure, and my own negligence. This assumption of risk applies whether I am driving my own vehicle, riding as a passenger in another member’s vehicle, or operating or riding in any other vehicle in connection with travel to or from Phi Sigma Sigma events, meetings, conferences, or activities.
3. Waiver and Release
   I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Phi Sigma Sigma, its officers, directors, employees, agents, volunteers, affiliates, and representatives (collectively, “Released Parties”) from any and all liability, claims, demands, causes of action, damages, losses, or expenses (including attorneys’ fees) arising out of or related to any injury, illness, death, or property damage that I may suffer as a result of my transportation to or from any Phi Sigma Sigma event, meeting, conference, or activity regardless of whether such injury or damage is caused in whole or in part by the negligence of the Released Parties.
4. Indemnification
   I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, causes of action, damages, judgments, losses, or expenses (including attorneys’ fees and court costs) arising out of or related to my transportation to or from Phi Sigma Sigma events, meetings, conferences, or activities, including but not limited to any claims brought by third parties for injuries or damages caused by my operation of a motor vehicle.
5. Insurance Acknowledgment
   I acknowledge that I am solely responsible for maintaining adequate automobile insurance coverage as required by applicable state law. I understand that Phi Sigma Sigma does not provide automobile insurance coverage for my travel to or from events, meetings, conferences, or activities, and I agree that I will maintain, at a minimum, the liability insurance coverage required by the laws of the state in which I operate my vehicle. I further acknowledge that any costs, deductibles, or uncovered losses arising from an accident during my travel are my sole financial responsibility.
6. Scope and Duration
   This Waiver and Release applies to all Phi Sigma Sigma events, meetings, conferences, trainings, and activities and shall remain in full force and effect indefinitely, unless and until superseded by a subsequent written agreement. This Waiver and Release covers travel to and from events, meetings, conferences, and activities, regardless of the geographic location of such events, meetings, conferences, or activities.
7. Severability
   If any provision of this Waiver and Release is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
8. Governing Law
   This Waiver and Release shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of laws principles. I agree that any action, suit, or proceeding arising out of or relating to this Waiver and Release, or to my transportation to or from any Phi Sigma Sigma event, meeting, conference, or activity shall be brought exclusively in the state or federal courts located in the State of Maryland. I agree to waiver any right I may have to a trial by jury in any action, suit, or proceeding arising out of or relating to this Waiver and Release, or to my transportation to or from any Phi Sigma Sigma event, meeting, conference, or activity.
9. Acknowledgment and Voluntary Execution
   I have read this Waiver and Release in its entirety. I fully understand its terms and conditions. I understand that by signing this document, I am giving up substantial legal rights, including the right to sue the Released Parties for injuries or damages arising from my transportation to and from Phi Sigma Sigma events, meetings, conferences, or activities. I sign this document voluntarily and of my own free will, without any inducement or assurance of any nature.
